OFFICIAL CONTEST RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED.
1. HOW TO ENTER
a. The 98.5 KLUC’S $98,000 Summer Sweepstakes (the “Contest”) will begin on May 23, 2008 at 5 p.m. PT and end on September 1, 2008 at 5 p.m. PT (the “Contest Period”).
b. To participate in the contest, you may enter via the following method(s):
On air: Any person who has won a prize from an on-air contest conducted by 98.5 KLUC (the “Station”) that takes place at any time during May 23, 2008 at 5:00pm PT and August 24, 2008 at 11:59 P.M. PST will be automatically entered into the Contest, pending confirmation of eligibility of this Contest.
On Line: Any person who has won a prize from an on-line contest conducted by the Station that takes place at any time during May 23, 2008 at 5:00pm PT and August 24, 2008 at 11:59 P.M. PST will be automatically entered into the Contest, pending confirmation of eligibility of this Contest.
Registration events: The Station will hold 4 registration events at Las Vegas Saturn dealerships (time and location TBD and will be announced on Station and posted on the Station’s website) during the Contest Period. During these events listeners will be allowed to enter the Contest by filling out an official entry form, available while supplies last, with their first and last name, complete mailing address, date of birth and telephone number. All entries must be received by the conclusion of the respective event.
c. The Station is not responsible for lost, stolen, mangled, misdelivered, illegible, incomplete or late entries.
d. Only one entry per person per registration event will be allowed.
2. ELIGIBILITY RESTRICTIONS
a. The contest is open to all persons who are 18 years of age or older and who legally reside in Clark and Nye counties in the state of Nevada. Employees of the Station, its licensee, its corporate parents, subsidiaries, and affiliates (collectively, the “Released Parties”), its advertising agencies, participating sponsors/promotional partners, other radio stations in the Las Vegas metropolitan area and the members of their immediate families and/or house holds are ineligible to participate or win.
b. Only one winner per household is permitted in any Station contest.
c. Contest winner must hold valid Nevada drivers license and have proof of insurance as of the start date of the Contest and prior to taking possession of the prize in order to claim the grand prize.
d. Contestants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements.
3. PRIZES
a. One (1) Grand Prize: The grand prize winner will receive a 2008 Saturn SKY. Approximate Retail Value: $27,000.00. Grand prize winner will be solely responsible for all car title, tax, tags, proof of insurance and license and registration fees, emissions inspection, freight, delivery, dealer prep, additional equipment, all federal, state and local taxes, insurance, gasoline, vehicle maintenance, all other fees and expenses not specified herein associated with the receipt and use of this prize vehicle. Winner must provide proof of insurance and a valid driver’s license and must take delivery at a dealership and time specified bysponsor. All obligations must be met before contestant takes possession of the car. The winner will accept the chosen prize vehicle "as is." Released Parties accept no responsibility for repairing any real or supposed damage to the prize car from this contest. If the Grand Prize is not available at sweepstakes end including vehicle color, a substitution of equal or greater value will be made at the Participating Station choice. Neither the Participating Station nor the other sponsors have made or are responsible in any manner for any warranties, representations, or guarantees, express or implied, in fact or law, relating to the Grand Prize vehicle, including without limitation, its quality, mechanical condition, merchantability, or fitness for a particular purpose, with the exception of any standard manufacturer's warranty that may apply to the vehicle. Any additional car options (including the interior and exterior color of the prize) not specified herein are subject to availability and will be the responsibility of the Winner.
b. The Grand Prize winner must pick up the car at the Saturn dealership located at 5325 W. Sahara Las Vegas, NV 89146. The winner will forfeit any prize or prize certificate not claimed within forty-five (45) days of winning. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Station is not responsible for the safe arrival of a prize or prize certificate.
c. There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
4. WINNER SELECTION AND NOTIFICATION
a. Decisions of the Station management with respect to the Contest are final.
b. On August 25, 2008, up to 500 qualifiers will be chosen by random drawing from all eligible entries (“Qualifiers”). The Station will notify the Qualifiers that they have qualified prior to the grand prize drawing event at the Saturn Dealership (location TBD) on September 1, 2008 from 11a.m. PT – 1 p.m. PT. If a qualifier cannot be contacted or is unable to receive a voicemail message from the Station, a replacement qualifier will be selected from a random drawing of the remaining eligible entries.
c. Qualifier check in: Contest Qualifier check in will take place from 11:00 a.m. PT – 12:30 p.m. PT Monday, September 1, 2008 at (location TBD). Only the Contest Qualifier is allowed to check in for the grand prize drawing. No proxies will be allowed. Any Qualifier who has not checked in with Station staff by 12:30 p.m. on September 1, will forfeit his/her chance of winning the grand prize.
d. Grand prize drawing will begin at 12:45 p.m. PT on September 1, 2008. The Station will randomly select a name from all the checked in qualifiers. The corresponding Qualifier will then randomly choose a CD from a container of CDs, place the CD inside the CD Player of a pre-selected car from Saturn. If the CD plays the “congratulations you’ve won” message, that will signify a winner of the grand prize. If the CD plays “you are not the winner” message then the Qualifier will be dismissed and a new qualifier will be randomly drawn from the grand prize drawing box to select a CD and start the process over. This process will continue till the “congratulations you’ve won” message is played. The number of CDs in the container will depend upon the number of qualifying winners that have checked in for the final grand prize drawing event. The first Qualifier to receive the winning message will be considered the winner. Once the “congratulations you’ve won” message is played, the Contest will end and no other Qualifiers will be allowed to try a CD in the CD player.
e. The grand prize winner must comply with all terms and conditions of these Official Rules; winning is contingent upon fulfilling all requirements. The potential grand prize winner must be present at the September 1, 2008 giveaway event, meet all eligibility requirements and must sign and return to Sponsor, an affidavit of eligibility and liability/publicity release in order to claim his/her prize.
f. Odds of qualifying depend upon the number of eligible entries received. Odds of a Qualifier winning the grand prize are approximately 1 in 500, but will depend on the number of Qualifier at the grand prize event.
g. Winner need be present to win.
h. Winners must execute and return any required Affidavit of Eligibility/Release of Liability Prize Acceptance Form within ten (10) days of notification attempt or prize will be forfeited and an alternate winner may be chosen by random drawing from remaining eligible entries.
5. CONDITIONS
a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners may be required to sign an IRS Form W-9 or the equivalent.
b. By participating in the contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, the Station in its sole discretion may require contest winners (and their travel companions, if any) to sign a liability release, agreeing to hold the Station, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.
d. The Station reserves the right to make changes in the rules of the contest, including the substitution of a prize or equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the contest and shall not be required to award a substitute prize.
e. Failure to comply with the contest rules may result in a contestant’s disqualification solely at the discretion of the Station.
f. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the contest, or in the announcement of a prize.
